Effective immediately, the Bureau of Quality Assurance (BQA) has
initiated the option to grant a statewide variance of certain provisions to Wisconsin
Administrative Code, Section HSS 131.43 (2) (a) 1.
Core Team. (a) 1. Each member of the core team shall be an employee or volunteer
of the hospice.
BQA will allow a variance to the core team requirements of ch. HSS 131,
Wisconsin Administrative Code. Specifically, this variance allows hospice agencies to
contract for the medical service member of the core team. Other core team members
(nursing, social services and bereavement) are not included in this variance and MUST
continue to be provided by an employee or volunteer of the hospice.
The Balanced Budget Act of 1997 included a provision that amended the federal core
services requirement to allow hospices to contract for physician services. Effective
August 5, 1997, Section 1861 (dd) (2) of the Social Security Act was amended so hospice
providers were no longer required to routinely provide all physician services directly.
This variance will bring Wisconsin Administrative Code, ch. HSS 131 in concert with
federal requirements.
This variance will not require a separate request for approval. Bureau of Quality
Assurance staff will be monitoring agency compliance with this variance during on-site
survey activities.
This code will be revised in future revisions of ch. HSS 131. The use of this variance
must not jeopardize the health, safety or welfare of any of the hospices clients.
The Bureau has the authority to rescind this variance at any time.
