To: Hospice Providers HSPCS 9

From: Rita Prigioni, Interim Director, Bureau of Quality Assurance

Effective immediately, the Bureau of Quality Assurance (BQA) has initiated the option for hospice providers to be granted a variance to Wisconsin Administrative Code, Section HSS 131.42(1)(b).

The registered nurse shall immediately record and sign a physician’s oral orders and shall obtain the physician’s countersignature within 10 days.

BQA will allow a variance to the "10 days" requirement of the code. Specifically, the variance we have granted allows the hospice providers to have 20 calendar days to obtain the physician’s countersignature on verbal orders. This variance will not require a separate request for approval, but will be evaluated in each hospice at the time of survey. This code will be revised in future revisions of HSS 131.

The use of this variance must not jeopardize the health, safety or welfare of any of the hospices’ clients. The Bureau has the authority to rescind this variance at any time.

If you have questions or concerns regarding this variance contact Jim Sniff, Unit Supervisor, Health Services Section, at (608) 267-7389 (replaced by Jan Heimbruch, (608) 243-2086); or Barbara Woodford, Nurse Consultant, Provider Regulation & Quality Improvement Section, at (715) 855-7310 (replaced by Marianne Missfeldt, (715) 836-4036).
