Legal Complaint/Action Against a Third Party

Let Wisconsin Medicaid Know When a Legal Complaint Is Filed

Sections 49.89, 102.27(2)(b), and 803.03, Wis. Stats., and SCR 20:1.15 and 20:8.4(f) require the attorney to contact Wisconsin Medicaid when a claim is filed against a third party or an insurance company/policy. 

The Department of Justice handles civil cases for Supplemental Security Income (SSI) clients with a subrogation lien over $2000 and Office of Legal Counsel handles civil cases for SSI clients with a subrogation lien under $2000. Contact the Casualty Recovery Program to determine where to mail the Summons and Complaint. 

The Corporation Counsel handles individual county cases; contact the Casualty Recovery Program to determine which county certified the client for Wisconsin Medicaid.

Medicaid HMOs handle their own subrogation. Contact the Casualty Recovery Program to determine which HMO covered the client.
