Minors - Admissions and Rights
Applies to: Anyone under 18 years of age who is receiving services for
mental health, substance abuse, or a developmental disability in the state
of Wisconsin.
The Legislature made significant changes to the rights of minors
regarding their inpatient admissions and their rights. Those changes are
set forth in 2005
Act 444 (exit DHFS), effective 8/1/06.
The following documents were prepared to assist treatment providers to
understand the current law.
Minors must be informed of their rights before or upon admission. Two pamphlets
have been created by the department that can be printed and used
as a supplement to the Patient Rights pamphlet that is required to be
given to all clients receiving services for mental health, substance abuse
or a developmental disability. One pamphlet is for inpatient treatment and
the other is for outpatient treatment. There are two versions of each pamphlet -
one in PDF format and one in Word. Service providers can modify the Word version to fit their
particular circumstances by, for instance, changing the work
"unit" to something more appropriate or adding their provider's
information on the front of the form.

The following documents were prepared to assist parents and guardians with
their roles in the treatment of minors.
Each Juvenile Court designates at least one Mental
Health Review Officer (MHRO) to review
the outpatient mental health treatment of minors aged 14 or older.
