DETERMINATION STATUS FOR IMPLEMENTATION OF PART C IN WISCONSINWisconsin's second Annual Performance Report (APR) for FFY 2006 (PDF, 337 KB) was originally submitted February 1, 2008. The Individuals with Disabilities Education Act (IDEA) requires that the DOE Secretary make an annual determination as to whether each State is meeting the requirements of the statute, based on the data submitted in the APR and other available information. You can access the Office of Special Education Programs' (OSEP) determination letter (PDF, 935 KB) regarding Wisconsin's performance, as well as the FFY 2006 APR response (PDF, 43 KB) at the OSEP's website. (Exit DHS) As you will see, Wisconsin is in the "Needs Assistance" category for the second year. The letter and table delineate the rationale for the determination. Since Wisconsin, along with 25 other states, is in category 2 for a second consecutive year, sanctions are required to be imposed. Pursuant to that, the DOE Secretary has advised the State of available sources of technical assistance. Wisconsin also is required to notify the public of this enforcement action. This notice is designed in part to satisfy that requirement. DHS is working with counties to provide the technical assistance that will be necessary to allow Wisconsin to "Meet Requirements" in the next FFY. Wisconsin prides itself on providing an exemplary Birth to 3 Program throughout the state, and is confident that the additional technical assistance accessed over the next year will demonstrate improved results.
